Ld. counsel for the plaintiff has also filed on record a copy of
MOU dated 11.09.2020 between plaintiff and deft No. 1 and
three others.
It is submitted that in view of consent terms executed by plaintiff
and deft. No. 1 on 11.09.2020 the dispute in the suit is settled in
terms of compromise and the plaintiff do not want to proceed
with the suit.
Plaintiff and Deft. No. 1 are present before the court with their
counsels and they both have admitted the contents of consent
terms. Hence, it is read and recorded. Deft. No. 2 is a formal
party.
In view of the consent terms, plaintiff is allowed to withdraw
the suit and it is disposed of as withdrawn. No orders as to
cost.
The decree shall be drawn accordingly.
The suit shall be registered for statistical purpose.
Authenticated copy of today's roznama to be handed over to
both the counsels for their information.
