ORDER- Heard the Ld advocate on behalf of both the parties in NM 4125/19. It appears that as the defendant due to illness could not consult the advocate to prepare the reply, the delay has been caused. The same contention is on solemn affirmation. Same is reliable and acceptable. Thus, there has been sufficient cause to condone the delay. The plaintiff did not object to the condonation of delay. Considering the shortness of delay and the overall circumstances, NM 4125/19 is allowed and the delay is condoned subject to cost of Rs.1000/- to be paid to the plaintiff. On payment of cost the reply be taken on record.
