ORAL ORDER
1. This Chamber Summons is taken out by the applicants to
take them on record of the suit as legal heirs of the deceased plaintiff
Ramesh Kamlakar Worlikar.
2. Perused the Chamber Summons. Heard advocates for the
parties at the length.

3. It is contended by the applicants that during the pendency
of the suit, deceased plaintiff Ramesh Kamlakar Worlikar has expired.
Applicants contended that applicant no.1 is wife of deceased plaintiff
Ramesh Kamlakar Worlikar and applicant nos.2 and 3 are sons of
deceased Ramesh Kamlakar Worlikar. They only legal heirs of deceased
plaintiff Ramesh Kamlakar Worlikar are entitled to be joined as
plaintiffs to the suit. Therefore, it is necessary to cause amendment in
the plaint by taking names of the applicants, who are legal heirs of
deceased plaintiff Ramesh Kamlakar Worlikar on record of this suit.
4. If the nature of the amendment is seen, it is pertaining to
taking legal heirs of deceased plaintiff Ramesh Kamlakar Worlikar on
record of this suit. The proposed amendment will not change the nature
of the suit in any way. Hence, the proposed amendment deserves to be
allowed for causing amendment in the plaint. Hence, I pass following
order.
ORDER
1. The Chamber Summons No.1984/2019 is allowed.
2. The applicants to carry out necessary amendment in the
plaint within 14 days from today
3. The Chamber Summons No.1984/2019 is disposed off.
