ORAL ORDER
This notice of motion is filed on behalf of plaintiff for restoration
of Notice of Motion no.2464/2018 dismissed in default. Notice of
Motion No. 2464/2018 came to be dismissed in default vide order
dated 08.07.2019. It is stated that due to transfer of file, plaintiff could
not attend the Court and work out the matter. Defendant filed reply to
the notice of motion and oppose to restore notice of motion. From the
record, it is seen that absence of plaintiff before the Court was not
intentional.

2. In this backdrop, it is just and necessary to restore Notice of
Motion no. 2464/2018 to its original stage. In the result, following
order is passed to meet both ends of justice
ORDER
Notice of Motion no. 4103 of 2019 is hereby allowed and Notice
of Motion no.6464/2018 is hereby restore to its original stage subject to
costs of Rs. 1,500/-. Costs amount be paid to defendant no.1.
