In the roznama dated 03/08/2019, my Ld. Predecessor has observed that there was no urgency to waive the notice under Section 80 of the CPC and directed to the compliance of the provisions of Section 80 of CPC. Section 80 of CPC provides that if the Court is satisfied that no urgency or immediate relief need to be granted in the suit, the Court shall return the plaint for presentation to it after compiling with the requirement of Sub-Section (1) of Section 80 of CPC. So, the plaint be returned to the plaintiff for presentation to it after compiling with the requirement of Sub-Section (1) of Section 80 of CPC.
NM No.4085/2019 does not survive. Accordingly, NM No.4085/2019 is disposed of.
