ORAL ORDER
1) The chamber summons is filed by the plaintiff to
serve the defendant through substitute service by paper
publication in two newspapers at Pune. The Chamber summons is
supported by affidavit of Shantilal Sanghvi who on oath stated
that the writ of summons of defendant No. 2 has written
unserved as not complete address. The writ of summons was
issued to the defendant No. 1 at the new address however it
returned with remark “left”. The plaintiff is knowing the last
known address of defendant No. 1. The defendant could not be
served hence prayed to allow the chamber summons.
2) I have gone through the record. The affidavit of
service shows that defendant No. 1 is not served and has left the

address. The defendant No. 1 could not be served and the
plaintiff is knowing the last known address of defendant No. 1
which he has left. Hence the chamber summons needs to be
allowed. Hence pass following order:
ORDER
1. The Chamber summons is made
absolute in terms of prayer (a).
2. The plaintiff to serve the writ of
summons in two daily newspapers
widely circulated in Pune.
3. Accordingly, chamber summons is
disposed of.
4. Chamber summons be registered for
statistical purpose.
