Proceedings indicate that defendants have served impugned notice dated 07.10.2019 on the plaintiff. The plaintiff has served a reply on defendants on 16.10.2019. However, the speaking order dated 31.10.2019 reveals that said reply was not considered by the defendants before passing the speaking order. Hence it is necessary to direct the defendants to consider the reply and documents, if any, filed by the plaintiff and to pass fresh speaking order. At the same time considering the submissions advanced the plaintiff needs to be directed to maintain status-quo in respect of the premises as seen in the photographs produced by the plaintiff at Exh.D collectively as well as the photograph seen in the inspection report submitted by the Corporation with list Exh. 2. Hence the order -
ORDER
1. Defendants are directed to consider the reply and documents, if any, filed by the plaintiff and to pass fresh speaking order.
2. Defendants shall not act upon impugned notice and impugned speaking order till passing of fresh speaking order and two weeks thereafter in case, the fresh speaking order is against the plaintiff.
