ORAL ORDER
1 This is an application filed by the defendant to direct his
department to release his retirement benefits. The defendant will
pay the recovery amount to the plaintiff.
2. The plaintiff filed say and has no objection to grant the
application.
3. On perusal of record, the plaintiff filed Notice of Motion No.
264 of 2020 for attachment of salary of defendant on the ground
that in case he receives all the retirement benefits and the suit is
decreed, the plaintiff will not be able to recover the decreed
amount. The notice was issued to the defendant. He appeared.
Roznama dated 30.01.2020 shows that the BMC was directed not

to release the arrears of salary, leave salary and encashment of
leave salary to the extent of Rs. 2,95,000/ till next date. The
plaintiff has no objection. Therefore, the above order of not
releasing the amount of salary, leave salary and encashment of
leave salary stands vacated. Accordingly, application is disposed of.
