There is delay in filing written statement. It is
matter of record that written statement is already
filed on record. The contents of para no.4 of the
affidavit in support executed by defendant shows
satisfactory reasons for not filing written statement
on record. Thus for giving fair opportunity to the
defendant to contest the suit on merits, the delay
can very well be condoned upon condition to place
written statement on record today itself with
supplying the copy to other side. Hence, I pass the
following order ORDER Notice of Motion No.
4028/2019 is allowed and made absolute in terms
of prayer clause (a) and written statement which is
on record be now marked as Exh.4 with a condition
that copy of written statement be served to Adv.for
plaintiff today itself. Notice of Motion is disposed of
accordingly.
