Proceedings indicate that notice u/s 354A was dated 23.10.2019 was pasted on the suit premises on 24.10.2019.  The plaintiff has replied said notice vide reply dated 25.10.2019. The acknowledgment by defendant on reply reveals that it is received by defendant on 25.10.2019.  However, the order dated 31.10.2019 mentions that plaintiff has not submitted reply nor documents. In view of this, the speaking order is passed in ignorance of the reply filed by the plaintiff. Hence, the plaintiff has made out a prima-facie case. Consequently I pass following order -
ORDER
1. The defendant shall pass a speaking order considering the reply and documents, if any, filed by the plaintiff.
2. The plaintiff is at liberty to produce additional documents before the designated officer within a week from today. If such documents are produced, the defendant shall consider said documents also while passing the speaking order.
3. The defendant shall not act upon the impugned notice till passing of the speaking order and two weeks thereafter from the date of service of speaking order on the plaintiff, in case the speaking order is adverse to the plaintiff.
4. The draft Notice of Motion is disposed of. It be registered for statistical purpose.
