      Perused chamber summons, affidavit in support thereof and affidavit in reply of defendant No.18. Heard both sides.
          Plaintiff submitted that advocates of defendant informed Court vide a pursis dated 17.10.2022 that defendant No.3,8,9 and 12 are no more. Therefore plaintiffs want to delete defendant Nos.3,8,9 and 12 from title clause of plaint.
          Defendant No.18 submitted that suit was filed against 19 defendants, relief was sought against all of them. During pendancy of the suit, aforesaid defendants passed away. Cause of action survives against heirs of those defendants. Plaintiffs are deleting names of deceased defendants. Plaintiffs and defendant Nos.1 to 17 are from same village. Plaintiffs know names of legal heirs of deceased defendants. They are trying to mislead. Defendant No.18 prayed for rejecting this chamber summons.
              I have heard both sides. The plaintiffs do not want to bring legal representatives of deceased defendants. Instead they want to delete names of deceased defendants. Plaintiffs will have to face the consequences. This Court cannot compel plaintiff to bring legal representatives of deceased defendants on record. With this I pass following order
ORDER
1) Chamber Summons No.159 of 2023 is allowed.
2) Plaintiff to carry out necessary amendment for deleting names of deceased defendant Nos.3,8,9 and 12 from title clause of plaint within four weeks.

     Defendant No.18 seeks setting aside no written statement order and permission to file written statement. The Motion is strongly opposed by plaintiff by filing reply.

    Record reveals that, defendant No.18 was served with writ of summons on 15.12.2019, however it failed to file written statement within the time stipulated by law. Later on no written statement order was passed on 08.02.2021.
      Plaintiff filed affidavit of examination in chief on 07.07.2022. Thereafter defendant has taken out present motion. Apparently there is delay of 02 years and 11 months. The delay is per se excessive. I find no sufficient reasons to support such huge delay. However, considering the rights of defendant No.18 involved in the present suit, refusing notice of motion would be too harsh. At the same time the plaintiff needs to be compensated for such huge delay. Hence the order
ORDER
1. Notice of Motion No.139/2023 is allowed subject to cost of Rs.20,000/- (Rupees twenty thousand only).
2. Cost to be paid/deposited within four weeks from today, payable to plaintiff.
