It will be decided as per the policy of the defendant as applicable at the relevant time whether plaintiff is eligible for alternate accommodation/ compensation or benefits of Kurar pattern. After decision on the plaintiff\''s eligibility or otherwise, plaintiff will be communicated whether he is eligible or not.  He submitted that due process of law will be followed.
   Considering the statement by the defendant\''s officer nothing survives in the suit as well as draft notice of motion. Hence the order -
ORDER
1. In view of statement made by defendant\''s officer, the draft Notice of Motion and the suit are disposed of.
2. The defendant shall communicate the plaintiff the outcome of inquiry being made about plaintiff\''s eligibility to have alternate accommodation or compensation or benefit of Kurar pattern.
