Ld. counsel for plaintiff tender register chamber summon no. 1827/2019.
Heard, ld counsel for plaintiff perused record as per the availment in the chamber summons plaintiff wants to amend the name of plaintiff in clause title. On the reason that the representative of plaintiff Mr. A. K. Narayanan has transfer to another branch and he is not available to look after the said suit in future and therefore the present officer who is working as a chief manager is a authorised signatory of plaintiff bank want to try the suit and therefore, the name of Bhartkumar Mehta be added in the title clause in the plaint. The present amendment which is incorporated by the plaintiff is in formal in nature without amendment plaintiff cannot put forward suit by way of evidence and therefore if the proposed amendment is granted no prejudice would be caused to the case of defendant and hence I proceeded to pass following order.
ORDER
1) Chamber summons No. 1827/2019 is allowed.
2) Plaintiff is permitted to substitute the name of existing office in place of Mr. A.K.Narayanan in the plaint.
3) Chamber Summons No. 1827/2019 is disposed of in the above said terms.
