Order
By way of present chamber summons plaintiff seeks to amend the
title clause of the plaintiff as per the schedule annexed to the
chamber summons.
The plaintiff has filed copy of order passed by Hon'ble National
Company Law Tribunal, Mumbai, dated 11.04.2019, as well as the
Certificate of Incorporation issued by Registrar of Companies,
Mumbai, dated 13.08.2019.
Heard both sides. AS the amendment sought is technical one, same
needs to be allowed. No prejudice is likely to caused to the other
side by the amendment. Hence, order
ORDER
1. Chamber Summons No.1874 of 2019 is allowed in terms of
prayer clause(a).
2. Plaintiff to carry out amendment within 14 days from the date
of this order.
3. Chamber Summons No.1874 of 2019 is disposed of accordingly.
Judge
Learned advocate for defendant submits that there is no likelihood
of settlement. In view of the same matter to proceed for hearing.
Matter adjourned to 10.10.2022 for compliance and cross
examination of plaintiff's witness.
