ORDER
1. This chamber summons is taken out on behalf of the plaintiff for
making amendment in the plaint.
2. Heard the learned counsel on behalf of the plaintiff. Read the
present chamber summons, affidavit of Avanti Anopchand Mody
Proprietor of the plaintiff in support of this chamber summons. Perused
record.
3. On scrutiny of the record it appears to me that the present suit
came to be filed on behalf of the plaintiff for recovery of amount. The
plaintiff has submitted in the present chamber summons that the

defendant has falsely denied the transaction in between the plaintiff
and defendant. Therefore, in order to bring the real fact and documents
in between the plaintiff and defendant, the plaintiff wants to make
amendment which are mentioned in the schedule.
4. On perusal of the record it appears to me that the issues are
framed on 15/06/2019, below Exhibit-06. The plaintiff has not filed
affidavit of evidence till this date. Considering the nature of the
proposed amendment, if it be allowed, then it will not cause any
hardship on the part of defendant and it will not surprise to the
defendant. Therefore, I inclined to allow this chamber summons. Hence,
I proceed to pass following order.
ORDER
1. Chamber Summons No.1865/2019 is hereby allowed as prayed for.
2. The plaintiff and its advocate are hereby directed to carry out
proposed amendment within stipulated period from the date of this
order.
3. Chamber Summons No.1865/2019 is disposed of accordingly.
