This is an application submitted by plaintiff for
continuation of adinterim order passed by this Court on 23/10/2019.
2. Heard ld. advocate Rele for plaintiff. It is strongly objected
by ld. advocate Chavan for MCGM.
3. Admittedly, there appear to be two structures i.e. 264 and
265. One structure of plaintiff is made eligible for required benefits and
another structure is not. There is a speaking order of MCGM that
plaintiff has submitted similar documents for both structures.
4. There is no order on merit given by the Court. For the
convenience of the hearing, adinterim protection was given till filing
reply and to submit the case at length by the both side. There is no
executory order passed by this Court, which require to be stayed.

5. It is material to note that impugned both structures are on
L.B.S. Road widening. In infrastructural project, neither adinterim
injunction can be given nor it can be continued. Resultantly,
application deserves to be rejected. Hence the order :
ORDER
1. Application vide Exh.4 stands rejected.
2. Application Exh.4 is disposed off accordingly.
