Record shows that the plaintiffs are heirs of Pushpavati to whom alternate accommodation was going to be allotted in redevelopment scheme. After the demise of Pushpavati inter se dispute seems to have started amongst her LRs. Therefore, prayer clause (a) in n/m can be allowed without prejudice to either side. Learned counsel Shri Nitin Nikam has given no objection to deposit rent amount and balance corpus amount in the court. Hence, ad-interim relief in terms of prayer clause (a) in N/m No.2958/2021 is granted with direction to defendants no.2 and 3 to deposit balance corpus amount and rent compensation due to be paid henceforth be deposited in the Court.

ORDER

2.The defendants no.2 and 3 shall deposit the entire corpus fund and rent compensation payable in respect of suit flat in this court within six weeks to be invested in a Nationalize Bank in fixed deposit subject to further orders/ till final decision of suit.

On careful perusal of record it appears the present plaintiffs have filed the affidavit of writ of summons Exhibit-10 on 01/10/2022 however, the Exhibit-8 is the vakalatnama filed by the defendant No.3 Om Sai Enterpreises and Builder in April 2021 (13/10/2021). The roznam dated 01/11/2022 speaks that the court passes ex-parte order against defendant No.2 and 3 even after filing of vakalatnama Exhibit-8 by defendant No.3 in April 2021 or in October 2021 as it is revels from the record. So now the stages have been corrected by this court. The suit proceeded without written statement against defendant No.1 and defendant No.3 and ex-parte against defendant No.2. Parties to take note.
