(in Roznama) 1)heard both the Ld. counsels. applicant has
taken out the CS stating that he has purchased suit premises
from plaintiff by deed of conveyance dated 06/09/2017
therefore he be substituted at the place of plaintiff in the
suit. he also produced such affidavit. perused deed of
conveyance annexed with list Exh. 12. 2) Plaintiff
submitted reply dated 12/03/2020 and submitted that he
does not have any interest in the suit premises etc. 3) Adv
of MCGM strongly opposed the CS. 4)However
considering the fact that this applicant is the purchaser of
suit premises the cs deserves to be allowed as prayed under
order 22 rule 10 of CPC, in the interest of justice.
5)Considering the peculiar facts, and circumstances I
proceed to pass following order :- a) CS no. 1837/19 stands
allowed as prayed for. b) Said amendment/corrections be
carried within 14 days from today. c) Said CS stands
disposed off. Matter adjourned for compliance to
25/02/2021.
