Order- The Advocate for the plaintiff Mr. Akshay R. Pai submits that vide Order dated 04.01.2021 passed in Notice of Motion No.501/2020, suit is ordered to be transferred to Summary Court and it was ordered to be registered a Summary Suit. He further submits that, in view of said order the suit should not be again transferred to this Court.
On perusal of record, it is seen that later on by physical verification certificate (A), His Honour Judge, Shri R. V. Kokare vide scrutiny dated 06.04.2021, certified that this Suit is identified as a Commercial case and therefore the suit was again transferred to this Court in view of said scrutiny/order.
It appears that there is order dated 04.01.2021 in Notice of Motion No.501/2020 by which suit was transferred to Summary Court and also there is order/scrutiny (dtd. 06.04.2021) holding suit as commercial dispute and transferred to Commercial Court.
Therefore, in the background of these two orders and to arrive at the final conclusion regarding giving effects to the orders, Addl. Registrar (Ms.S.S. Dhakane) shall prepare notesheet to put up before the Hon\''ble Principal Judge as there are many such cases pending before the Commercial Courts.
