ORDER
1. All the parties in the present suit were present on
25.06.2025 and filed consent terms (Exhibit 07) before the Court and
submitted that the decree be passed in view of the consent terms.
2. The present matter was referred to the mediation and
mediation report is filed on record. It is mentioned in clause 5 that one
Dhaku alias Manjula is not party to the suit. The plaintiffs agreed and
undertook to keep indemnify the defendant No.1 and his heirs from any
claim either by the heirs/legal representatives, their agents and/or

anybody claiming through Dhaku alias Manjula or any of the family
members. Dhaku alias Manjula is not part to the suit, still parties have
agreed and mentioned about her future claim. It reflect, parties wants
to end the litigation and shown their bonafides. All the parties to the
suit agreed with the consent terms. Under such circumstances, this
Court is of the view that the decree by the consent terms can be passed.
Hence, I pass the following order :
ORDER
1. The Suit No. 2987 of 20119 is decreed in view of the Consent
Terms at Exhibit 7.
2. Decree be drawn up as per the consent terms.
3. Consent Terms Exhibit 7 be formed part and parcel of the decree.
4. Court fees can be refundable as per rules.
5. In view of the disposal of the suit, the Notice of Motion No. 4867
of 2019 is also disposed of accordingly.
6. The order is digitally signed; hence, it be uploaded on Case
Information System (CIS) and the printout of the digitally signed
order, additionally signed by me for the purpose of physical
record, be kept on record.
