Perused the C/s and say filed today on backside of the
leaf by Ld. Adv for defendant. Heard both side. Ch/su is
moved by plaintiff no.6 for deleting the name of plaintiff
no.2,3 and 4 from the cause title along with affidavit
According to plaintiff no.6, plaintiff no.2,3 and 4 expired
on 24/12/2018 ,24/12/2015 and 11/02/2019
respectively. Death certificates are annexed.
Ld. Adv for defendant consented to allow the Chamber
Summons.
In view of the above facts, Chamber Summons needs to
be allowed. Hence following order
ORDER
1. C/s is hereby allowed in terms of prayer clause
(a).
2. Plaintiff to carry out the necessary amendment
within 14 days as prayed and to file amended
copy on record and serve the same to other side.
3. Chamber Summons 1815 of 2019 is disposed off
accordingly.
Ld. Adv for plaintiff tendered copy of Appeal From Order
No. 299 of 2015 and ordered that The trial Court shall
expedite hearing of the suit.
Both the advocate requested adjournment for N.M.
hearing.
