Abdul Majid Gigani is present and filed preceipe it is taken
on record and marked as Exh.6
The plaintiff filed application for withdrawal of suit. It is
taken on record and marked as Exh.7 O- Other side to say.
Adv. Sunita Khamkar for defendant no. 1 present and
offered no objection for withdrawal of the suit
unconditionally. The plaintiffs authorized signatory admit
that the plaintiff doesnt want to proceed with the suit
against both the defendants and wants to withdraw the same
unconditionally. From the perusal of the record, it is
apparent that the defendant no. 2 is a formal party to the
suit and no relief is claimed against him. The said defendant
no. 2 didnt appear in this matter. In this view of the matter
the plaintiff is allowed to withdraw the suit unconditionally
and the suit stands withdrawn/abandoned against both the
defendant under Order 23 Rule 1 of The Code of Civil
Procedure. In view of the abandonment of the claim against
the defendants the pending NM No. 1726/17 and NM No.
3763/19 will not survive and stand disposed of as
dismissed.
