SCHEDULE OF TRIAL DETERMINED AFTER CASE MANAGEMENT HEARING
(ORDER XVA RULE 1 OF CPC)
Heard learned counsel Ms. Suchita Dongre for the plaintiff
and learned counsel Shri Rupesh Lanjekar for the defendant on the
point of case management hearing. In this suit, case management
hearing was conducted and schedule of trial (Exh.16) was determined
on 02/09/2021, but matter came to be fixed for admission and denial
of parties. Therefore, earlier schedule (Exh.16) could not be followed.
Meanwhile, the plaintiff filed list of witness (Exh.17). Similarly, the
defendant filed list of witness (Exh.18). The plaintiff also placed on
record evidence affidavit of PW 1 Ajit Singh. The plaintiff and
defendant filed statement of admission and denial (Exh.21 and 23
respectively). Considering these developments, case management
hearing is conducted again in consonance with Order XVA Rule 1 and 5
of the CPC. Following schedule of case management is determined :

1. Evidence of the witnesses of the plaintiff to be recorded by
conducting crossexamination and reexamination – on or before
27/04/2022.
2. Filing affidavits of evidence of all witnesses simultaneously by the
defendant (see Order XVIII Rule 4 (1A) and Order XIX Rule 6 of
the CPC) – on or before 10/06/2022.
3. Evidence of the witnesses of the defendant to be recorded by
conducting crossexamination and reexamination – on or before
02/07/2022.
4. Filing of written arguments by both sides (see Order XVIII Rule 2
(3A) to (3E) of the CPC) – on or before 16/07/2022.
5. For advancing oral arguments with time limit of two hours to
either side. (see Order XVIII Rule 2 (3F) of the CPC) – on or
before 30/07/2022.
Both sides are directed to adhere to time frame as far as
possible. Consequences for noncompliance with orders as per Order
XVA Rule 8 of the CPC may ensue/follow.
