Adv. for the defendant no. 1 vide say on the overleaf of the notice of motion strongly resisted the ad-interim relief on the ground that after granting ample opportunities, this court has ultimately dismissed the earlier notice of motion in default. He, therefore, submitted that there is no reason to grant ad-interim protection unless the main notice of motion is restored.
Having regard to the entire facts and circumstances, there cannot be any doubt after the matter was severally kept for dismissal of notice of motion, the order of dismissed in default of the notice of motion no. 2117/17 was passed. However, it is equally important to note that the ad-interim relief was granted after considering the submissions of both sides. Therefore, considering all these circumstances, it will be just and appropriate to direct the parties to maintain status-quo regarding the suit premises till next date with directions to the plaintiff to serve this notice of motion upon defendant no. 2. Hence, parties are directed to maintain status-quo in respect of the suit premises till next date.
