ORDER below Chamber summons No. 256/21
The chamber summons is filed by plaintiff to bring on record legal heirs of deceased defendant expired on 01.11.2020. The chamber summons is supported by affidavit of Manoj Khemka. He stated on oath that plaintiff came to know on 01.11.2020 that defendant expired. Therefore to bring on record legal heirs of deceased defendant. The legal heirs of defendant filed reply and objected on ground that plaintiff has not stated true facts of residents of legal heirs. Mr. Harshal Kishor Raut and his married sisters Mrs. Hemangi Mangesh patil are not residing along with the proposed defendant Hitesh Raut. They are residing in United States of America and the address is also stated in the reply. They admitted that they are the only legal heirs of deceased defendant No. 1. The suit is filed to declare that plaintiffs have right, title, interest and possession of the suit premises. Considering the nature of relief, the legal heirs of deceased defendant are necessary parties thus needs to be brought on record. The death of defendant is on 01.11.2020. The plaintiff came to know about the death about the same date. They filed chamber summons on 01.02.2021. There is delay of around two days. Adv. For plaintiff stated that said delay be condoned. Adv. For defendant has no objection for condoning two days delay. Considering the reliefs and as the present legal heirs are necessary for adjudication of the dispute in the interest of justice as the delay is of two days, needs to be condoned. Hence pass following order
1. The Chamber summons is allowed by condoning delay of two days.
2. The prayer (a) of chamber summons is made absolute.
3. The plaintiff to carryout necessary amendment within limitation.
4. Accordingly, Chamber summons is disposed of.
