Order-
After perusal of the Plaint, the allegations are made against defts. no. 3 to 5 that they are allowing deft. no. 2 to erect mobile tower on the suit building without consent of the plaintiff and other occupants of the building without following guidelines in respect thereof issued by deft. no. 1/MCGM. The prayers are made against all defendants that they be permanently  restrained from erecting mobile tower on the suit building. The grievance against deft. no. 1/MCGM, a local authority, is that they have not given reply or taken action to the complaints against defts. no. 2 to 5. However, it is not contention of the plaintiff that the deft. no. 1/MCGM has granted permission for the mobile tower illegally. During course of arguments, Ld.  Adv. for plaintiff submits that the plaintiff is kept in dark and presence of deft. no. 1/MCGM is required to bring before the court the procedure followed by it for granting permission. From the above aspects and prayers in the plaint, the real dispute in  connection with the mobile tower is between the plaintiff and defts. no. 2 to 5 for restraining them from erecting mobile tower on the suit building. In this suit the plaintiff will have to establish that the defts. No. 2 to 5 have no right to erect mobile tower without consent of the plaintiffs and other occupants of the suit building and without following guidelines issued by deft. no. 1/MCGM. In the above backdrop the Civil Court can not grant prayers (a) and (b) of the plaint against deft. no. 1/MCGM to direct the same to grant/deny the permission in a particular manner. The discretion of the commissioner or such authority cannot be substituted by the Civil Court. If the plaintiff succeeds in establishing his case against deft. no. 2 to 5 and prayers in the plaint will be granted then the plaintiff can approach office of deft. no. 1/MCGM with copy of the order of Civil Court in respect of the subject matter and the latter will be duty bound to follow the Court\''s order. Therefore, presence of deft. no. 1/MCGM to decide controversy between the parties in this set of facts is not necessary. Hence, name of deft. no. 1/MCGM be deleted from the plaint. Consequently, the suit remains between private parties and therefore, Registrar, City Civil Court, Mumbai to assign the matter to the court dealing with private Civil Suits for disposal in accordance with Law.

Heard argument of ld.adv for plaintiff in NM No.4047/19. The statements made in the affidavit filed in support of NM by the plff that defendants are illegally trying to erect a mobile tower on the terrace of the building Bhagyalaxmi Villa have gone on record unchallenged as despite granting several opportunities, defendants have failed to file reply to the Notice of Motion. In fact, nobody has attended the matter for and on behalf of the defendants on any date after 05.02.2020. Plaintiffs have produced document in support of their contentions raised in the plaint and in the affidavit in support of a Notice of Motion. Defendants cannot erect a mobile tower without following the due process of law. Status quo order is already granted in favour of the plaintiff as per order dt.14.10.2019 by the Court by hearing the advocates for plaintiff and defendant No.3. Ld. Advocate for the plaintiff submitted that after passing of the said order, there is a status quo till date at the building and the further construction of the tower is not undertaken by the defendants. Having regards to the fact that defendants failed to contest the Notice of Motion, this court is of the opinion that since the defendants are not appearing , it would be in the interest of justice to allow this Notice of Motion pending final decision of the suit. Thus an order.
                          ORDER
Pending final disposal of the suit, defendants are temporarily restrained from erecting, installing and operating Cell tower on the terrace of Bhagylaxmi Villa Building, without following the due process of law.
