The plaintiff has sought to withdraw the suit on the ground that, because of inadvertence the order passed u/S.351 to the notice remain to be challenged in the suit and wants to challenge the same. The plaintiff therefore, had sought to withdraw the suit.
The Ld. Adv. For the defendant/Corporation object on the ground that, the plaintiff by withdrawal of the suit is seeking to feel of the lacking.
     The plaintiff is required to challenge the notice and the order. Admittedly the plaintiff is challenge only the notice u/S. 351.

1)   In order to avoid multiplicity of the suit, the plaintiff is allowed to withdraw the suit.
