Order passed below Chamber Summons No.1726 of 2019
Perused chamber summons, affidavit in support of it and also
record and proceeding. Heard advocate for plaintiff.
Chamber summons is taken out by plaintiff for substituted service
of writ of summons upon defendant as he is avoiding to accept writ of
summons. I have gone through roznama of present matter and also
affidavit of service. It is clear that defendant was not found at the
address given in the cause title and it was informed that he leaves
residence in morning and comes in late night. Thus, it is clear that
defendant is keeping out of the way for the purpose of avoiding
service. Therefore, writ of summons be served upon him by affixing
copy of writ of summons in conspicuous place in court house and also
upon some conspicuous part of house in which defendant resides.
More so, some service of summons also be made by ordinary mode.
Accordingly, chamber summons is allowed in above terms and
disposed off.
