Heard Ld. counsel for plaintiff on draft NM also perused the photographs of suit sides. Plaintiff\''s claim in the suit is for declaration, possession and perpetual injunction against the defendant and he has also sought interim relief of temporary injunction during pendancy of the suit.
Ld. counsel for plaintiff referred to paragraph no. 3 of supporting affidavit of draft NM and pointed out that at the time of agreement he has paid an amount of Rs. 26,00,000/- as a token amount in cash/cheque. Recently the plaintiff has come to know that earlier, the defendant/respondent has executed General Power of Attorney in favour of one Mr. Jain in respect of suit property on 28.10.15 and has cheated the plaintiff by executing agreement of sale. Plaintiff has also lodged a compliant in this Regard to the Police. The plaintiff also apprehend that the defendant/respondent are trying to execute an agreement with another party behind the back of the plaintiff. Hence, there is urgency for maintaining the status quo as on today in respect of the suit property during the pendancy of the suit.
In view of the above submissions made before the court and perusal of the documents filed on record, I satisfied that a case of urgent interim relief is made out by the plaintiff. Hence, I proceed to pass the following order-
Order
1. Issue notice to the respondent to show cause why the relief prayed for in the NM should not be granted to the plaintiff/applicant.
2. In the mean while defendant/respondent no. 1 to 6 are hereby directed to maintain status quo in respect of the legal status of the suit property as on today and not to create third party rights till the next date.
3.Ld. counsel for plaintiff is directed to communicate this order to the defendant for the information and compliance. Ld. counsel for plaintiff to serve the defendant/respondent by the short service and submit affidavit of service by next date.

Ld. counsel for plaintiff submitted that inspite of the order of status quo granted by the court the defendants have committed trespass and encroached on suit property on 23.10.19 and complaint has been lodged in police station on 24.10.19 in that regard. Ld. counsel for defendants denied the allegations and submitted that the order of status quo was continued till 16.10.19.
Considering the submissions made before the court on 17.10.19 by the Ld. counsel for plaintiff regarding the possibility of settlement, that option was kept open to the parties but, no further order of status quo was passed.
However, it is a practice followed in the court that the parties are expected to maintain status quo when the court is seized of the matter, no formal orders are necessary regarding maintaining status quo by the parties.
In view of the above, Ld. counsel for both the sides directed to inform their respective clients to keep peace and not to take law in their hands till the court decide motion.
