ORDER IN DRAFT NM
Heard. This is notice of motion for restoration of the suit
which was dismissed during the stage of removal of
objection.
As the matter was dismissed at the stage of institution, it is not
necessary to issue notice to the defendants. The litigant cannot be
punished for mistake of his advocate and opportunity can be given
to the plaintiff to remove the objections. Hence, application
deserves to be allowed. Hence following order.
ORDER
1. Draft NM is allowed.
2. The unregistered suit is restored subject to payment of cost of Rs.
3000/- to the Library of City Civil Court Bar Association within
four weeks failing which the suit shall be dismissed.
3. Draft NM be registered for statistical purpose.
