ORDER
Plaintiff has filed this Miscellaneous Application for
correcting typographical errors in judgment dated 16.02.2019.
2. It is argued on behalf of plaintiff that the name of
defendant is Ardeshir B. Cursetjee. However in judgment due to
oversight in the middle name instead of “B” “N” is mentioned.
Therefore, it is necessary to correct it. So also in para number 1st of the
judgment instead of correct word “flag” wrong word “flat” is mentioned.
Therefore, it is necessary to correct the same. I have gone through the
copy of plaint and judgment. In copy of plaint middle name of
defendant is shown as “B” while in judgment it is shown as “N”. So also

in plaint the correct word is “flag” while in judgment it is wrongly
mentioned as “flat”. It is nothing but typographical error. So Court is
empowered to correct typographical errors in its judgment. Therefore,
application needs to be allowed for necessary correction. Accordingly
the order.
ORDER
1. Misc. Application No.94/2019 in Summary Suit
No.8372/1995 is hereby allowed.
2. In the judgment dated 16.02.2019 in Summary Suit
No.8372/1995 in title clause in the name of defendant
correct word “B” be replaced at the place of “N”. So also in
pleading wherever word “flat” is mentioned it be replaced
by word “flag”.
