By praecipe matter is taken on today's board.
Adv. Abhishek Tripathi for plaintiff present and filed draft CS along
with affidavit for amendment for deleting name of defendant no. 4
who has died on 14.08.19. he also submitted that defendant no. 6 to
8 have relinquished their aright title and interest in respect of the suit
premises in favour of defendant no. 9 on 11.07.19. Hence, their
names are also to be deleted.
Adv. Rohan Pawar for defendant no. 1 to 11 present and submitted
that he has no objection to allow the draft CS as a matter is likely to
be settled.
Heard both sides. In view of the submissions made before the court,
the draft CS is allowed in the interest of justice. Amendment be
carried out in three days. The CS be registered for statistical purpose.
Ld. counsel for plaintiff and office to do the needful and comply.

Application filed by Ld. counsel for plaintiff for withdrawal of the suit
against defendant no. 11
The Ld. counsel for defendant no. 11 has no objection the withdrawal
of the suit against him.
In view of the above submissions, application at Ex-35 is allowed in
the interest of justice as per order passed on it. Suit stands
withdrawn against defendant no. 11.
