ORDER IN NM 1265/2021
This motion is taken out by the defendant for condonation of delay in filing the written statement. Motion is opposed by the plaintiff by affidavit in reply. It is the contention of the defendant that summons were received on 11.04.2019. The earlier advocate did not follow up the suit. Thereafter, new advocate has been appointed by the defendant. Thereafter there was period of pandemic. For all these reasons the defendant was not able to file the written statement. It is admitted position that the period of limitation due to pandemic is excluded from 15.03.2020 to 28.02.2022. The suit summons as per the contentions of the defendant have been served on 11.04.2019. Period of 30 days expired on 11.05.2019. Even period of summer vacation is excluded,  period of 30 days expired in the second week of June 2019. Period of 90 days expired in the month of July 2019.  Therefore, the period of limitation for filing the written statement has expired much before the period of pandemic. The defendant will not be benefited by the order of exclusion of limitation during the pandemic. Inspite of these observations I have to consider the grounds stated in the motion about change of advocate. It is the contentnion of the defendant that his earlier advocate did not take follow up of the matter. He was required to change the advocate. I am of the view that due to this reason the valuable right of filing written statement cannot be denied. Considering the facts stated in the motion and also in the interest of justice I am of the view to allow the motion with following order.
ORDER
1. Notice of Motion No.1265/2021 is allowed subject to costs of Rs.3,500/- (Rupees Three Thousand Five Hundred only).
2. Delay in filing written statement is condoned.
3. Costs shall be paid to the plaintiff.
4. Defendant is allowed to file written statement.
5. Notice of Motion No.1265/2021 is disposed of accordingly.
