The plaintiff has tendered adjournment application TOR marked as Exh.19. The defendant has no objection for adjournment, however, it appears that the counsel of plaintiff yet not tender his Vakalatnama, the memo of appearance was given on 12-06-2024. The counsel of plaintiff is submitted that Revision Application filed by defendant, is pending before Honble Bombay High Court, where the counsel of plaintiff made a statement that he will seek adjournment in this suit. However, the statement made by plaintiff will not operate indefinite stay to this proceeding which is pending since 2004. There are guidelines and directions of Honble Supreme Court and Honble Bombay High Court to dispose off old matters on at earliest and expeditiously. There is no stay granted by Honble Bombay High Court to this proceeding. In case of Sanju Kumar Singh V/s State of Bihar report in MANU/SCOR/11194/2023, the Honble Supreme Court opined that mere filing of appeal would not operate at this stay, unless there is an interim order. It is to note that as per roznama dated 13-07-2023, the plaintiff himself filed a pursis at Exh.14 intimating to this court that the stay of the present suit is vacated. As per roznama dated 21-02-2024, the plaintiff has advanced argument on Chamber Summons, now, the Chamber Summons is pending for argument of defendant. Therefore, it is made clear, if matter is not proceeded on next date, appropriate order will be passed.
