     Defendant No. 3 has taken out this notice of notion for filing written statement and condonation of delay of 389 days. Plaintiff failed to file reply. Hence, no say order has been passed. Perused the notice of motion and affidavit in support of notice of motion. It is submitted that technically there is delay of 42 days and period during the lock-down to affirmation of WS as well as notice of motion is 347 days, total amounting to 389 days. It is submitted that in view of Order of Hon’ble Supreme Court in Suo Motu Writ Petition No. 3 of 2020. The period between 15.03.2020 till 28.02.2022 is condoned for computation of limitation.
