O R D E R
This is Notice of Motion taken out by the plaintiffs for setting
aside the order passed dated 07/08/2019 and permitted to the plaintiffs
to examine to the defendant witness. This notice of motion resisted on
behalf of the defendants by filing their reply. Read the present Notice of
Motion, affidavit of the plaintiff no.2 in support of this notice of motion
and reply of the defendant thereon. Heard both the learned counsels on
behalf of both the sides at length. Perused the record.
2. On scrutiny of the record, it appears that on 07/08/2019, the
matter was posted for cross examination to the D.W.1. On that day,
the Defendant's officer Mr.Prakash Sonawane was present. The
advocate for the plaintiff requested short adjournment for cross
examination to this witness was rejected on 7/08/2019. If the

permission is granted to the plaintiff to cross examination to the DW1
by setting aside no cross order, then defendant will not suffer any loss.
Moreover, the matter be decided on merits. Hence, I proceed to pass
following order.
ORDER
1. Plaintiffs notice of motion no. 3456/19 is hereby allowed as prayed
for subject to cost of Rs.500/.
2.The plaintiff shall deposit cost of amount of Rs.500/ in the office of
District Legal Authority, Mumbai.
3. Notice of motion no.3456/19 is disposed off accordingly.
