Advocate Mr. Shahajad Irani for plaintiff is present.
Advocate Mr. Sutar for defendant/BMC present.
Officer Mr. Sandesh Pendharakar, J.E., B&F, E/Ward, BMC
present and stated on oath that, the reply of the plaintiff
against the notice 15.05.2019 is still pending for decision
by the defendants. Till decision on the reply of the
defendants the defendants will not take any action against
the plaintiff in respect of the suit premises.
Heard both the Ld. advocates for both the parties.
Therefore, I proceed to pass following order:
ORDER
1. The defendants/BMC shall not take any coercive action
in
pursuance of the notice dated 15.05.2019 u/s.351 of the
BMC
Act issued by the defendants to the plaintiff till ten days
after
passing speaking order.
2. The suit of the plaintiff is hereby disposed off.
3. Draft NM of the plaintiff is disposed off accordingly. Suit
and
draft NM be registered for statistical purpose.
