The applicant appeared through CA. CA appeared on 02.08.2022 and argued on the application No.95/21. He has argued for a long period and has mentioned many things about consent term and about contempt petition. After going through the record I got confused and I verified about the situation from counsel for respondent No.1. Considering the financial position and as I found that the applicant has not received the gratuity and PF funds of the employee. I asked the company whether it is possible to release their claims and matter get settled. Accordingly the respondent No.2 gave offer and waived the rent amount and agreed to give the PF and gratuity amount if the applicant is ready to vacate the premises. When I asked about the orders passed by the Hon''ble High Court and about contempt petition the counsel for respondent had pointed out that no order is in favour of appellant. The orders which the applicant has mentioned are set aside therefore I asked the applicant present in person, CA was not present though called repeatedly. I informed the applicant (Son of applicant) that CA has not disclosed about subsequent orders. The matter was kept today to inform whether the settlement is possible. Today the applicant appeared and has stated that he is not agree with the calculations made by the company. As I heard the application No.95/21. The matter was kept for order today. Today in the afternoon at 02.00pm I received the e-mail from CA making allegations on this court that the court has made allegations against the CA about misguiding, fabrication and forgery which is not correct. The CA was not present in the court. Whatever I have stated is about not disclosing the orders and judgments passed in this matter. This mail is nothing but giving threats to the judicial officer. The conduct of the CA not coming before the court and sending such mails will be viewed seriously.
The applicant has filed this application (Exh.19) for grant of adjournment. As the matter is not settled and these are the prolonging tactics of appellant, I have passed the order on the application rejecting for adding the TATA Sons as necessary parties. The adjournment application and MA 95/21 are rejected.
