ORDER
1. The plaintiff has filed instant Notice of Motion for framing of
additional issue.
2. it is contended by the plaintiff that it is alleged by the
defendant that they have agreed to pay Rs. 25,000/ per month as
professional fees for installation of lift and not lumpsum amount of
Rs. 2,50,000/. The aforesaid issue needs to be framed.

3. Ld. Advocate for the defendant has formally opposed the
application. I have perused the pleadings of the parties. In my
view, the proposed issue needs to be framed. Thus, I proceed to
pass the following order :
ORDER
1. Notice of Motion No.3439 of 2019 is hereby allowed in terms
of prayer clause (a) and following issue be framed :
“Defendant proves that the plaintiff had agreed to pay him
Rs.25,000/ per month as professional fee till the installation
of lift is completed, as alleged by the defendant and not
lumpsum amount of Rs.2,50,000/ for the installation of the
lift”
2. Notice of Motion No.3439 of 2019 is disposed off
accordingly.
