Perused roznama. On perusing record, it appears that defendants No.2 and 3 appeared in the matter on 25.08.2022 and took out notice of motion No.3874/2022 to condon delay to cause their appearance. The said Notice of Motion came to be allowed on 16.02.2023, subject to costs of Rs.3,000/-. It is the submission of plaintiff that defendants No.2 and 3 have not complied the directions of costs. Even, there is nothing on record to show that defendants No.2 and 3 have paid the costs or deposited in the court. Thus, it cannot be said that defendants No.2 and 3 have appeared in the matter.
