present and submitted the application for withdrawal of the
suit with liberty to file fresh suit. Application for
withdrawal of the suit with liberty to file fresh suit on behalf
of plaintiff. None present for defendant. Heard plaintiff and
his counsel. It is submitted that plaintiff and defendant have
mutually settled the matter outside the court. Therefore,
plaintiff do not want to proceed with the present suit.
However, it is prayed on behalf of the plaintiff that liberty
may be granted to file a fresh suit against the defendant for
specific performance, if and when required. In view of the
submissions made before the court, plaintiff is allowed to
withdraw the suit with liberty to file fresh suit as per
provisions O/23 and R/3(b) of CPC. Plaintiff shall be
entitled to refund of court fees as per rules. Suit is disposed
as withdrawn.
