ORDER
1. Defendant no.6 has taken out the notice of motion for
condonation of delay of 125 days in filing written statement and for
taking written statement on record. Perused notice of motion and say
given at the backside of it. Heard learned counsel Sneha Sonawane for
defendant no.6 and learned counsel Shri Clifford Martis for the plaintiff.

2. On perusal of the record, it appears that defendant no.6 is
not duly served with writ of summons. Defendant no.6 received
information of the suit proceeding from other defendants who are her
relatives. Considering all these attending circumstances, defendant
no.6 has explained the legal aspects allowing her to file written
statement. Furthermore, ground of ailment and time required for
instructing the advocate for representing her can be taken into
consideration. Hence, I pass the following order :
ORDER
1. Notice of Motion No. 1690/2020 is made absolute in terms
of prayer clause (a) and (b).
2. Defendant no.6 is directed to file written statement on or
before the next date of hearing.
3. Proceeding of N/m No. 1690/2020 is closed.
