ORDER ON CHAMBER SUMMONS NO.1642/19.
Defendant No.2 has taken out present C/S seeking
condonation of delay of 72 days in filing
appearance. Record reveals long standing absence
of defendant No.2. So also no reply is filed to C/S
by the plaintiff. Considering short issued involved
same is taken up for hearing. Perused the C/S and
the affidavit filed in its support. It is contented
that defendant No.2 had been to his native place
in Uttar Pradesh owing to death of his younger
brother. It is also contented that some dispute
over the family property of defendant No.2 had
arose that made him to stay there for considerable
time. So also some other reasons are provided to
contend that there were genuine and bonafide
reasons behind the delay. Considering the fact that
still matter is at preliminary stage and the reasons
mentioned for delay, I find delay deserves to be
condoned in the interest of justice. Hence, the
order ORDER. 1. Chamber Summon No.1642 of
2019 is allowed, subject to cost of Rs.2,000/
(Rupees Two Thousands Only). 2. Cost be
deposited to DLSA Mumbai, within four weeks
from the date of this order. 3. Chamber Summon
No.1642 of 2019 is disposed of accordingly.
