ORDER
1. By this chamber summons, Judgment Debtor has prayed
for calling of Record & Proceeding of execution filed before the Ld.
Registrar of this Court with prayer of staying the execution proceeding.
2. It is the contention of Judgment Debtor that Record &
Proceeding filed before the Ld. Registrar of this Court is necessary for
adjudication of execution and the objection raised by him.
3. The Decree Holder resisted the contention of Judgment
Debtor by filing reply and prayed for rejection of the chamber

summons.
4. It reveals from the record that the Record & Proceeding
filed before the Ld. Registrar of this Court is already received by this
Court. It is the contention of the Ld. Counsel for Judgment Debtor that
after filing of this chamber summons, the Record & Proceeding filed
before the Ld. Registrar of this Court is received. Therefore, he does
not want to proceed with this chamber summons. Considering the fact
that Record & Proceeding is already received by this Court and thus,
this chamber summons has become infructuous. With this, I proceed to
pass following order :
O R D E R
1. Chamber Summon No.1638/2019 in Execution Application
No.94/2019 in S.C. Suit No.1327/2017 is hereby dismissed.
2. Chamber summons disposed of accordingly.
