The suit is of the year 2019. The defendant by NM No.661/2022 prayed for condonation of delay in filing Vakalatnama. The NM was allowed on 12.01.2023 and on 19.04.2023 defendant filed VP. However, since then no any steps are taken by plaintiff nor the plaintiff or their counsel attended the court. As per the Bombay City Civil Courts Rule 119 (4) when no decree is applied within 6 months and the plaintiff fails to appear, then the suit should be kept for dismissal order. Admittedly from 19.04.2023 till today i.e almost 26 months have elapsed wherein, the plaintiff failed to file the SJ. On 12.03.2025 specific direction was given to plaintiff to take steps failing which appropriate order will be passed. Inspite of it today neither plaintiff nor their advocate are present nor any steps are taken. Thus it seems that plaintiff company has lost interest in pursuing their suit hence suit is dismissed for want of prosecution.
