the sole defendant who was the mother of the plaintiff expired
on 21-01-2022 and hence, the suit becomes infructuous. The
application is supported with a copy of death certificate which
prima-facie shoes that the defendant namely Sakkar Hasen Ali
Virani died on 23-01-2022 while she was residing at third floor
Aga Ali Manor, Mazgaon, Mumbai. Considering the
submissions made by the Ld. Counsel for plaintiff , I would
find substance in the application. The suit stands accordingly
abandon and disposed of being infructuous. The pending C/S
No. 1625/19, NM No. 4569/18 and NM No. 2686/22 stands
accordingly disposed of. Admissible Court be if any be
refunded to the plaintiff.
