ORDER
1. Heard Learned Advocate for the plaintif and learned
Advocate for the defendant corporation.
2. The plaintif by this notice of motion seeks restoration of
the Notice of Motion No. 2748/2017.
The Notice of Motion bearing No. 2748/2017 was
dismissed for want of prosecution on 15.04.2019. The plaintif
seeks to restore the said notice of motion. It is stated that the
plaintif lost the track of the suit and the plaintif was under
impression that the defendants were to fle the say to the

notice of motion.
3. The notice of motion is opposed by the defendant
corporation. The reasons mentioned in the notice of motion
and in order to provide fair opportunity to the plaintiff the
notice of motion is restored.
In the resultf following order is passed.
ORDER
1) The Notice of Motion No.3340/2019 is allowed.
2) The Notice of Motion No.2748/2017 is restored.
3) The plaintif to deposit the cost of Rs.1f000/- with the
District Legal Services Authority.
4) Put up for argument on Notice of Motion No. 2748/2017 dtd.
02/03/2020.
