He has also produced the judgment of the Hon\''ble Bombay High Court ( Aurangabad bench ) in Udhav Baliram Adavale Vs Babruwan Papanarsh Gaikwad, MANU/MH/1641/2017 wherein it is laid down that when summons or notice of the court issued by RPAD is returned with a remark \'' intimation posted\'' , \''not claimed\'' or \''unclaimed\'' the same cannot be accepted as a good service. The judgment of the Hon\''ble Bombay High Court is binding upon this court. In view of the above observations, the matter cannot be proceeded exparte on the basis of the report. Mr. Jiken Modi- Authorized Representative of plaintiff present before this court and filed the application for withdrawal (Exh-8) of the suit and submitted that the defendant have settled the matter with plaintiff by paying all outstanding dues. Therefore, plaintiff is no longer desirous to proceed with the present suit.
