ORDER
1. This is an application for permission to submit details of
expenditure and income received from the property of Smt. Shirin
Shabbir Dada.
2. According to the applicant, she is appointed as a guardian
of the mentally ill person Smt. Shirin in Guardian Petition 19/2016.
M.A. NO. 57 OF 2018, was filed for getting permission to file details of
expenditure/income received from the property of Smt. Shirin. Now,
the applicant wants to file expenditure incurred for medical treatment
to the mentally ill person from 01.08.2018 to 31.07.2019. Its details
are filed at Exh. 3. According to the applicant, flat in Vithal Court
Apartment CHS Ltd., is standing in the name of mentally ill person. She

has filed copy of order of Dy. Registrar, Cooperative Society “D” Ward
and copy of share certificate.
3. I have heard Advocate for the applicant.
4. On perusal of the papers, it appears that, this applicant was
appointed as a Guardian of mentally ill person and was also appointed
as a Manager of Estate of the said mentally ill person. The applicant
was directed to submit details of expenditure and income received from
the property of mentally ill person as ordered in Guardian Petition No.
19/2016. So, it needs to be allowed.
5. So far as second prayer is concerned, that cannot be
considered at this stage, as the property of the mentally ill person is not
sold. Affidavit is filed in support of the application. Therefore, I am of
the opinion that the application deserves to be partly allowed.
Accordingly, I proceed to pass order in following terms.
ORDER
1. Misc. Application No. 82 of 2019 is partly allowed.
2. Prayer regarding filing of income and expenditure statement in
compliance of order in Guardian Petition No. 19/2016 is allowed.
3. Misc. Application No. 82 of 2019 is disposed off accordingly.
