Advocate for Plaintiff submitted that Plaintiff will have no objection to allow Notice of Motion no.3298/19 filed by Defendant for setting aside exparte order dated 09/04/2019 and for condoning delay of 141 days caused in filing Written Statement if Defendants will be directed to pay some cost amount to Plaintiff and as such Plaintiff is not intending to file reply to the Notice of Motion no.3298/19. Considering no objection given by the Plaintiff for giving fair opportunity to Defendants to contest the suit, Notice of Motion no.3298/19 is made absolute in terms of prayer clauses (a) to (c), subject to cost of Rs.1410/- to be paid by Defendants to Plaintiff.
